Following a road traffic accident you will incur losses not
covered by your own insurance. If your car insurance is
comprehensive you will be entitled to have your own car
either repaired or replaced, all other losses are
'Uninsured Losses'. If your car insurance is third party
then all your losses arising out of the accident are
uninsured. It is your legal entitlement to claim your
'Uninsured Losses' from the driver at fault and may include
all or some of the following:
The provision of a replacement vehicle
Compensation for personal injury
Loss of earnings
Out of pocket expenses
Your policy excess
Because the accident was not your fault you are fully
entitled to recover all your losses from the at-fault
drivers insurer. If you do go through your own insurer you
may temporarily lose your no claims bonus as well as having
to pay excess, which could be as much as £500 or more. It is
also unlikely that your insurance company will offer you a
vehicle similar to your own as a replacement.
If you are comprehensively insured, the time it takes
for your own insurers to deal with either the repair
or replacement of your vehicle is on average 4 weeks. If you
are insured on a third party basis then the claim will take
as long as it takes the other party's insurers to deal with
your losses.
